1. Acceptance of Terms

By accessing or using the service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the service.

2. Description of Service

OFXStatement provides bank statement conversion and data processing services. We reserve the right to modify, suspend, or discontinue the service at any time without notice.

3. User Accounts

To use certain features of our service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account.

4. User Content

Our service allows you to upload, submit, store, and share content. By uploading content to our service, you:

  • Grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content in connection with providing our service to you
  • Represent and warrant that you own or have the necessary rights to such content and that it does not violate the rights of any third party

5. Subscription and Payments

Some aspects of the service are provided on a subscription basis. Payment for subscriptions must be made in advance. We reserve the right to change subscription fees upon reasonable notice. Every payment is final, and the narrow exceptions are listed in our Refund Policy, which forms part of these Terms.

Renewals and failed payments. An OFXStatement plan keeps renewing each month or year until you turn renewal off in your account. On the first day of a new period the full period and its page quota become available and its fee is owed. A declined card leaves that fee unpaid and we try the charge again. Turning off renewal once a period has started affects only the periods after it, and the fee for the current one is still owed and is not refunded; you keep access until that period ends. You pay for having the converter available, not for each conversion, so a period without uploads gives no right to a refund.

6. Limitation of Liability

In no event shall OFXStatement, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the service
  • Any conduct or content of any third party on the service
  • Any content obtained from the service
  • Unauthorized access, use, or alteration of your transmissions or content

7. Disclaimer

Your use of the service is at your sole risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. The service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws applicable in your jurisdiction, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page and updating the "Last Updated" date.
